  1. Default What's the Rule?


    for publishing photos with recognizable faces in them such as the water park photos that yellalablady has in her water park series?

    If I have things correct, you need a model release for portraits and such but what about public stuff? I couldn't do a search since I didn't really know what to use as search terms.

    You can publish, however, you cannot profit from photos (other than editorial use) without a model release.

    Note: That is in the US, I am not sure about other countries.

    Three of the people in the water park photo better give me permission or they don't get dinner. The third guy well y'all are the only ones seeing him. If anyone objects, I'll remove him.
    Michael, do you get releases from all the people in your street shots?

    Oh, good. I though I might have done something wrong. This is usually the only place I post shots of strangers. I feel it's ok at the Zo because there aren't too many out there stranger than this bunch.

    Here is a handy legal opinion that you can download in pdf format..

    Generally, people in public places have no expectation of privacy and can be photographed by anyone with a camera. The general population does not have any "right" to be compensated, nor do you need a release, if they are in your photograph of that public place, recognizable or not..

    Regardless, if you are selling images to a stock distributor for commercial use that contains a recognisable model/human subject, they may require a copy of your "release" before accepting your photo.. It is prudent to get one if this is the intent as it will spell out everybody's expectations.

    Sorry Monnie, I wasn't trying to insinuate that you did anything wrong. I have been curious about the subject for some time and your thread brought it to mind again.

    Please remember, this is how the Media get their shots for the news paper.
